The first stage of litigation could be characterized by disclosures of evidence at first by both parties and discovery which is the supervised exchange of evidence and documents between the parties based upon what they expect to present at trial. Discovery is designed to remove doubts and to provide clarity on exactly what the litigation is all about and, perhaps, to help parties realize that they need to end the lawsuit or settle it prior to using up money and time.
In this stage, the parties can also participate in pretrial motion filing to avoid or add specific facts or legal issues prior to trial by preventing the other party from appearing as an individual witness or asserting an underlying legal principle.
